TLC Hauling llc Rental Agreement

1. Delivery: will be to the address specified above by lessee. There is no standard delivery fee. Delivery is curbside unless otherwise agreed upon and may include an additional fee dependent upon added distance, terrain, level changes, etc. Delivery and set up are two separate entities. Set up shall be by Lessee unless otherwise agreed upon, possibly for an additional fee. Set up would only be for opening and a rough placement of items, no rearranging will be done by Lessor if we are setting up the equipment. Lessee grants Lessor rights to enter the above noted delivery address for delivery and subsequent pick up of rented equipment during the agreed upon time frames. Lessee is responsible for and only permitted to use the rental items at the delivery address unless express prior consent is given by the Lessor.

2. Inspection: It shall be the Lessees responsibility to inspect the rental items upon delivery and ensure the proper number of items have been delivered and are in acceptable working condition, and to notify the Lessor of any discrepancies or defects. Lessee is expected to maintain rented equipment in normal working order and notify Lessor of any damage or need for repair and replacement. Lessor shall make every attempt to replace defective equipment in a timely manner for the Lessee.

3. No Warranty: is given by the Lessor for evident or hidden defects in materials, workmanship, or capacities of equipment. Lessor is not the manufacturer nor an agent of said properties. Lessor is not responsible for any damage, injury, or death caused by any defect, malfunction of, or misuse of rented equipment. The manufacturer rated capacity for the chairs is 400 pounds/ 181kg each.

4. Hold Harmless Agreement: Lessee agrees to hold harmless, indemnify, and defend the Lessor and/or its agents from and against any and all claims, liabilities, losses, and damages to property or bodily injury (including death) or otherwise and expenses of every character whatsoever resulting from the actions, negligent or otherwise, of Lessee.

5. Return of Equipment, Damage, Theft, & Loss: Lessee is responsible for the safe keeping of all rented property and the safe return of such in a clean, normal working condition. Although normal wear and tear and occasional damage from normal use may occur, Lessee is responsible for any and all lost and stolen items plus any damage from misuse/ non intended for use/ abuse of equipment. Although subject to change with documentation, the current cost of a chair is $30 and an eight foot table is $100, and six foot table is $80.

6. Inclement Weather and Other Risks: Lessor shall at all times have the right to remove any and/or all rental items from event spaces in the presence of severe weather or other issues pertaining to the safety of the rental equipment from damage. Lessor shall have final say as to whether conditions and other safety factors.

7. Permits and Licenses: Customer is responsible for knowing of and obtaining any necessary permits, licenses, and/or other consents needed for the location and time of the event. Lessee is also responsible for knowing of all above ground and below ground hazards such as wires, gas or water lines, septic areas, etc that may be a hazard while securing and placing the rental equipment. Lessee is encouraged to call 211 digs at least three days prior to delivery and set up if they are unsure.

8. Pick Up: All items shall be cleared, clean, and accessible for removal at the agreed upon time. Any additional work may incur an additional charge for time and labor.

9. Cancellation Policy: Your paid deposit was obtained. A full refund will be granted with a minimum notification of 14 days prior to the scheduled set up date for any reason. Cancellation after the 14 days will be forfeited to the Lessor unless a comparable rental is known/ found for the date in question. This shall be at the discretion of the Lessor. Lessee shall be responsible for payment in full if cancellation occurs within 72 hours of delivery date.
